Why Zardari Did It?
By Ali Yar Khan • Feb 15th, 2010 • Category: Politics, Worth A Second Look • 14 CommentsIt’s extremely preposterous to even think that the cunning President Zardari didn’t have an idea about the implications and the reactions of his decision to outrightly reject the recommendations of the supreme court’s top judge and make his own decision.
He very well knew that Chief Justice (Justice Iftikhar Muhammad Chaudhry would kowtow in front of him. If you look at it, this matter is not as big as some people are thinking it is. The government is itself blowing it out of proportions. Actually they want something else.
They want a safe and promising exit. If they go out silently, then rest assured most of them go straight to jail or in exile or out of politics forever. They want some fight, some clash and some dirt flowing hither and thither. They cannot fight with the establishment, and they cannot fight with the popular PML-N. Their only soft target is the judiciary, because the lawyer leaders are divided.
They want judiciary to take some action against them, so that they go out and yell that once again they have become the victim of judges. They would correlate their ouster to the hanging of Zulfikar Bhutto and the way their slain leader Benazir Bhutto termed the then courts as Kangaroo courts.
It’s wrong to say that the Justice Saqib Nisar, by not taking oath as the chief justice of the Lahore High Court, has foiled a conspiracy allegedly prepared by President Asif Ali Zardari and Prime Minister Yousuf Raza Gilani against the judiciary. Actually, the justices have done what was natural, and what was sought by the legal advisors of the ruling duo.
But now free media and aware people willl not shed a single tear for Zardari regime. They have lost their chance and they are asking for it. They have not failed to find yet another Dogar in the present supreme court, they have also lost whatever credibility they had. Now even Sindh card would not help them.

Zardari is suffering from mad cow (or should I say mad dog) disease, he should be put down ASAP otherwise he will destroy the Pakistan.
Hope all gets well.
If an elected President uses his powers and appoint judges ( according to his likings, with or without consultation) and then Supreme Court uses its power and suspends that order ( which they can do ).
I fail to understands how is this an issue ? What is the issue all about ?
If there is a presidential notification, it is our right to like or dislike it. What is all the fuss about?
@ 3. Dear you are right there should be no issue. But our Lords of Justice are making an issue out of it. Our President has done what our constitution says, elevation of the senior most judge. And both the judges have proven past affiliation with PML-N. I fail to understand the intransigence/ arrogance of our Chief Lord. So what if one judge is elevated this way or that way, they are both his own judges.

So the issue is of the President doing his job or the Chief Justice doing his ?
Or is it that we dont like coz Zardari did it? And we will only have it the Chief Justice’s way only ?

Had the media reacted the same way if Rafiq Tarrar did the same decision?
In simple : “A” President doing his job VS “A” Chief Justice not liking his decision.
Forget who is who for a moment and tell me who is right and who is wrong ?
The media has gone insane.
It is simple issue of governance. No other country makes such noise over routine matters like elevation of judges. Let the institutions decide about these. Media (especially Jang Group) should mind its policy of cashing on constitutional matters. Everyone is insane these days thanks to so called free media.

Worst times have arrived therefore Mr. 10% (ten percent) have become leaders of our beloved country. I will not go into the details how corrupt our leaders are. Along with corruption they don’t care if poor people live or die. Zardari and his government have sold our country for few dollars and now our national interests are also on sale by him. When I think about the situation in Pakistan my heart really goes, looking at the necessity which Pakistani nation does not have, such as Sugar, Wheat flour, Electricity, Gas, jobs, clean drinking water and there is huge list of other necessities which Pakistani nation does not enjoy. However leaders of Pakistan have turned a blind eye to the problems of poor people. I always wonder that why Pakistan does not utilizes 18 billion people and produce various items which can later be sold in international market such as Airplanes, Fast Trains, Weapon technology and various other items. Leaders of Pakistan have pledged to neglect this nation and they are extremely busy filling their own pockets with stolen poor people’s money. I pray to God that the injustice vanishes soon and we see a real and authentic leader who can lead us through prosperity and happiness. I believe the leaders of Pakistan have failed to look after their country and they have failed to show care. We as a nation should unite together and raise against the ignorance we face today. It is clearly stated in our constitution Clause # 177 (1) “The Chief Justice of Pakistan shall be appointed by the President, and each of the other Judges shall be appointed by the President after consultation with Chief Justice”
In current issue, Zardari did not consult with CJP and proceeded to appoint the Judges at his own behest which is an open violation of aforementioned clause.
The President has acted totally in accordance with the constitution. Those judges who refused to comply with the govt notification have gone all out against the constitution of the land!
According to the Constitution of Pakistan (Article 177) on the appointment of Supreme Court judges” “The Chief Justice of Pakistan shall be appointed by the President, and each of the other Judges shall be appointed by the President after consultation with the Chief Justice.”
The constitution clarifies “consultation” thus: “consultation shall, save in respect of appointments of Judges of the Supreme Court and High Courts, mean discussion and deliberation which shall not be binding on the President.”
It isn’t difficult to see who has violated the constitution and committed treason .The Chief Judge should voluntarily step down!

So even if your statement is accepted then the supreme court has struck it down and is going to resolve it in a court of law.

I cannot fathom that Chief Justice of Pakistan will misinterpret the constitution and will declare a legal notification null and void…..why would he do that ?

“save in respect of appointments of Judges of the Supreme Court and High Courts, ”
means its meaning has not changed or this issue is an exception.
Even in dictator’s \LFO and the clause mentioned above they left the meaning of consultation in case of judicial appointments as it is meaning binding or meaningful consultation.
you ve probably misunderstood the phrase used in the article.
