By Talal Hussain Malik • Jul 10th, 2009 • Category: Politics • 18 CommentsJUST when the Supreme Court played its role issuing stay order against introduction of new Carbon Surcharge Tax in lieu of already sky high petroleum levy showing how it is possible to give relief to the people when government itself failed, the government played its card, in a crooked way as usual and petrol is being sold at the same price yet again. Well, this clearly shows that our man on top is well aware of how to use the back doors when the gates are being watched by sentinels. But public has its own way of reacting to situations.
What the government did by introducing the Petroleum Levy Ordinance might produce far more repercussions than what the government would have expected, I mean this is such a stupid act taken at a time when the common lot feels so contented in cursing the PPP government for inflation, for the Damocles’ sword of expected increasing electricity tariff and not to forget the sizzling hot weather that affects the temperaments to a considerable extent. I can see a quick response by the public that may soon ensue.
It may surprise some factors as to why the government showed such a sense of urgency in re-imposing the tax with a different name, my answer to that surprise is-we have Mr.10% as our president, who knows how much share he has under the disguise of petroleum levy. Pakistan Zindabaad!

Mr. Talal Malik, let’s get this one fact straighten first, in a parliamentry democracy it is the Parliament (the legislative branch of the state) who makes a law by a majority vote. Right? Once the law is made then the Government (the executive brance of the state) enforces it. Right? In this case, the government used its prerogative of imposing a tax, fulfilled its legal requirement and went to the parliament, got the law passed. Now, here what we have is a case where the Supreme Court (the Judicial branch of the state) intervenes which you have so generously termed playing “its role”. Not really! It’s a case of one branch of the state over stepping its boundry and trespasing (actually encroaching upon someone els’s right !) jurisdictions beyond its limit. Malik Sahib, claim a legal education and background - you, for one, ought to know it better, that, here the Supreme Court had no ‘allowed’ or ‘assigned’ role to play.
AS I see this is some intrigue hatched and put to work to create another conflict between the Judiciary and the Government, thus making the PPP government unpopular, and one does not need to be a political whiz to see who the beneficiaries are here, you guessed it - it is PML-of Nawaz. Look how neat the scheme is, the Carbon Tax is allowed through the Finance Bill passed by the parliament by the majority with the support of Nawaz-PML and then PML-Nawaz sends its Secrtary General a man called some kind of Jhagra ( tell me he dared it without the blessings of his ‘masters’)to the Supreme Court of Pakistan and appeals there to strike it down. It is done. Now.
The government allows itself “the pleasure” of the ‘Petroleum Levy Ordinance’. You could be right, hopefully not, this has all the ingredients of even a greater rift between the two branches of the state ‘again’! If it does degenerate into a full blown conflict, we can expect some ‘fireworks’ here. Since this conflict can easily be exploited as an issue between a ‘people friendly’ (poor people, I might add) and the terrible ‘people hating’ government of PPP. Guess who the herald will be, yes the ‘messiha’ the ’savior’ in waiting (and actively hatching all such plans) in the guise of ‘democratic supporters’ of the present democratically elected government.

no matter hhow many times i see it i am always surprised, that after such an open act of making people’s life miserable, how can PPP calim to be the peoples’ party, its not working for the people, kiss mun se kehtay hain keh “hum awam doost hain”
i mean if they had to do it they could have passed the ordinance a few days later but the timing shows the very next day of the SC verdict, zardari and his cronies put their heads togather and thought up this plan as if slapping the people in the face and asking “we have got you this time!”
and during all this hassan has set out on his mission of making CJP look bad

the ministers of PPP are being look worried and exhausted in front of media in justifying the wrong doings of zardari and co, actions of rehman malik and short term policies of shaukat tareen.
This budget gives us very clear picture that why tareen has bee sent to our area and it is to generate revenue in the form of interests rate from people’s income and to destroy the already existing production capacity so that money would be transferred to 1st world donors.
Not a single step toward industrial production, or for working class has been taken.Farmers would be more suppressed as all feudal characters are holding good positions in state affairs so coming time is more tough and tough under zardari regime.
Zardari has already taken revenge to his wife who didnt do anything in his 9 year jail term and now he is taking full actions against people of Pakistan who always cursed and discarded him as important person of state.

switch on any TV channel and they’re all condemning CJ Chaudhry for his illegal interference in administrative affairs. You and your aunt Nazia can continue expressing your deep-rooted grudges against PPP, MQM, democracy, but that doesn’t make any difference. You are provoking others to invite the same sort of response you and your aunt invited from Khaled Farooqui, Rashid Saeed and many other realists.

its good you have time to watch tv other then HBO.Try to watch talk shows other than PTV and enjoy strong criticism on corruption and wrong doings of govt specially after 8 pm.Zardari and his team is rated on top in his worst management by these tv programs.I hope you agree with me as true realists

The government may be popular or not, but this is not the issue. The issue here is that the CJ overstepped from his constitutional domain to interfere in taxation matters which purely fall within the domain of the elected administration. This is what Ayaz Amir Sahab stated.I don’t hate CJ Chaudhry at all. I only condemn his interference in administrative matters of the state.
If you’re so much fed up of my realistic comments, then wait till another 2 weeks as by then I’ll be back at work and won’t be wasting my time trying to convince you and your nephew about the reality.
No one is harassing arias or you. Don’t call those who disagree with you as dummy characters Khaled , Nasir, Rashid, Aftab, Ayesha etc are not dummy characters. Rather its your and this innocent nephew of yours who are all the time using derogatory language about democratic, elected leaders of Pakistan. i know you are sensitive, so dont take may remarks as rude, but the other day the same tv channel you are quoting told that on his trip to USA zardari, stayed in a suite with a price tag of
USD 5000, that suite had an area of 3000 SQFT, and the funny thing is that Bilawal did not spend the night in zardari’s suite, bilawal stayed in another suite @ 2500 USD per night, didnt bilawal find a place to sleep in zardari’s 3000 SQFT
this is a harsh reality which you may not want to hear as it would pop your dream in which zardari is a hero, so considering you sensitivity please stay away from the reality

Aroused by his reinstatement, CJP is galloping waywardly in his judicial ranch and many a times scaled it boundaries and tresspassed the administrative domains of the government,
A decision supported by the majority of the assembly, whatever harsh it may be, should have been honoured and not subject to judicial activism.
Acting as judicial dictator, CJ is bound to cripple the state machinery and this may lead to a situation where severe clash with the executive is imminent.
He must learn from the past and while upholding the independence of judiciary, draw lines and respect the sovereignty of the parliament.
He should target the cause and not try to mitigate the effect. He should have questioned the governments loan agreements with IMF which are causing all these problems, if at all he wanted to act as ‘Commander Safeguard’.

Hassan / Nazia, there is no harm in defending someone. Every body has a right to accuse/ defend anyone of public importance, as per his/ her affiliations, backgrounds, upbringing, agendas and biases. But when replying to each other we all should reply with some level of maturity and responsiblity. Diversity of views is the essence of democracy.
Problem here is that some commentators on TPS leave their objectivity at home and keep harping on the same tunes. It is forgatten that “iss hammam mein sab nangey hain.” Be it Zardari, Nawaz, Imran Khan, Altaf Hussain, CJP etc…Every saint has a past and every sinner has a future.
We act childish when it comes to the issues of public interest, this country can not afford only blame games. We shuld realize where my domain ends and your jurisdiction starts. Hate mongers and instigators, be it in media, agencies or anywhere, should be exposed and banished. We should behave in a mature way.

Aftab Sahib, it surprises me when you use the word ‘Boundaries’ for where jurisdiction of the Supreme Court is concerned. Government of the people, by the people, for the people, known well for its slogan of ‘roti, kapra aur makaan’, which has never been fulfilled nor will even be especially when the gangster is guarding the godown. Regardless of whether or not it was a conspiracy hatched by PMLN, I would go on to say that CJ should take up the issue of NRO and nip the evil in the bud before it further destroys of what remains in the storm.
