The parliament in the light of above may always constitute a commission like Hamoodur Rehman Commission and put up recommendations for the necessary implementation as well as ratification by both the houses.

Dear Aftab A Alam and Friends,

#58

All the people who considers themselves the victim of some crime when refer to courts they have one thing in their mind; Revenge but the courts are the high held organ of governments which in order to sustain the order and normalcy in the life of affected; the courts delivers them not the order to satiate revenge of aggrieved party but they get Justice.

But No Judge may be the member of any bench or court appointed to deliver a judgment where a judge in person is witness or his own position becomes the subject in any form in the case under consideration.

In the light of above the decision taken by the court in present petition of 3 November 2007 case----However a decision or court judgement may be found good or may prove serving the so called national common cause; but the ethics of court on the account of the cardinal principles of Natural justice, “no person should be judge in his own cause” as well as the commonsense demands that when our CJP is presiding the bench in this case where he is the subject witness in the case as well is the beneficiary of the decision. The judgment is worth throwing out of the window into rubbish.

Anyhow there should be no hesitation in saying that Judgement whatever it is; it is a ‘Self Serving Judgement.’

To read the contents of Judgement please follow the link provided at: # 29 and read in between the lines that whether CJP is beneficiary here or not?

Arias @ 55
Arguments, counter arguments, for the sake of arguments will lead us to nowhere. Difference of opinion is everybody's right and as you said very rightly, politicians, dictators, good people, bad people come and go but it is the common people who suffer.
Let the people be the better judge themselves and remain united for a strong Pakistan.

O' anytime! Sure, I am honored by the natural endowment of this wisdom to differentiate between profound and ordinary.

Arias, you almost sound as if you feel personally targetted, I sincerely hope that you are not part of this 'evil' - that'll be a horrible error of judgment on my part - I somehow still consider you an honorable man. Since, you, hopefully, are an honorable man (even if manipulated by propagandists and manufacturers of opinion), and as a friend let me give you a bit of advice - people guided by sense of justice never compromise even when they do not posses power to prevent injustice - they always posses the wisdom & courage to protest - make this your resolution from now henceforth.

Good luck!

please refresh your memory and you will discover that ganja jee being the PM, had the right to dismiss and apoint the COAS, and when mush was returning from his golf trip in sri lanka, Musharaf had been dismissed by the PM so this fable of high treason can be laid to rest as mush while in air was an ordinary citizen, so is there something wrong ordinary people going to india?

and this is the reason why i say mush was not the coas, after 12 oct 1999 it was other traitors like muzaffar usmani who hepled him stay as COAS and President

Khokar Sahabjee, your objection is valid and point you present validating your argument can not be contested by anyone who has any respect for 'any priciples' at all, be it a legal priciple or ethical values. Having said that, I must also point this out here & now, you have to forgive this poor fellow Arias here for his sense of justice, after all the man is a beneficiary of pop songs wisdom & Medona is his inspiration!
What can you expect from anyone asking such naive questions like, "can you tell clause of whish article in Pak constitution says its an offence?" (Ref#52 in response to Nasir, "Yes, very much right as NS wanted his army chief to land in Ahmedabad, the enemy’s land. An unforgivable offence.").

Someone should just tell him as well as to those sitting in the Highest Court of the land that :

Yes the authors of our constitution could not stretch their imagination to such lunacy, yes indeed they failed to imagine the possibility of an elected PM indulging, for his personal sense of personal glory, in such extreme criminal act of forcing our own in service Chief of The Army Staff to go and land in enemy territory - if this is not an act of High Treason then none is and if perpetrator/s of such an outrageously evil crime is deemed and declared innocent then either we as nation have reached collective insanity or lost a sense of justice completely. And only God can now help us recover from this malady - so help us God!

Dear Arias,
# 35
It is ample clear from the Para 22 I &ii of the judgment that while presiding the said larger Bench while considering the case of promulgation of emergency and the circumstances surrounding CJP himself when he was placed redundant and there by the said bench has duly reconfirmed CJP position---- rather it has been made more firmed and clearer and his rival CJ Abdul Hameed Dogar who was placed against him has been condemned all together.

If this is not getting his self benefitted that what is this?

CJP Ifitkhar Muhammad Choudhary himself is the real beneficiary of the said Judgment here and contrary to one of the cardinal principles of Natural justice, “no person should be judge in his own cause” had headed the Bench. Hence, in view of the facts and reasons stated above Chief justice Iftikhar Muhammad Chaudhry the Chief Justice of Pakistan as per Constitution is in contravention of the act being himself the real beneficiary of the said Judgment and contrary to one of the cardinal principles of Natural justice stated above.
