Implications of Detailed Judgement of NRO

By Dr. Hassan Isfahani • Jan 20th, 2010 • Category: Politics, Worth A Second Look • 6 Comments

Clash is on, arms are out. Supreme Court has dished out its detailed verdict upon the infamous NRO, and the government has returned the recommendations of chief justice after making objections on it. The government ministers and governors are out making all kinds of threatening gestures. President himself is out to garner some votes before he is shown the door by the establishment.

NRO has been declared in direct conflict with the spirit of constitution and the supreme court has ordered to reopen the cases once again and has also given references to the cased from Nigeria and Philippines as reference. NRO was for the protection of corruption, while this verdict is for the nullification of the corruption. Most importantly the courts have declared that it will be court which will decide about the cases within and outside the country. Now all the cases are open as NRO vanishes, which was the legacy of dictator Musharraf. Moreover, this decision also states that the chairman NAB and prosecutor general are untrustworthy.

The court has said that the NRO ensured legal cover to corruption by the privileged class. In its landmark and the expected judgment, a 17-member bench of the apex court headed by Chief Justice Iftikhar Muhammad Chaudhry had declared the NRO an instrument void ab initio, being ultra vires and violative of various constitutional provisions including Articles 4, 8, 25, 62(f), 63(i)(p), 89, 175 and 227 of the Constitution.

The truth is that the short order of NRO was suffice to send tremors in the ranks of the corrupt regime. They know that their days are numbered and they cannot hide their corruption and those swiss accounts will become the last nails in their government’s coffin. That is why the president is out and running campaign for himself. He is announcing the projects which will never see the light of the day. Even after NRO, all those corruption stories regarding Rental Power Plants and Steel Mills and some others are enough to prove that only ruthless justice can end the corruption.

The truth is that that is why we restored the judiciary. Now judiciary is asking Sultan tough questions. Now judiciary is not afraid of anyone. They are invincible and they are not deterred by any pressure or fear. Now what next? Government has to implement much portion of this verdict by the apex court. If government delays or hesitate in applying these orders, then apex court could send the executive to jail for contempt of court. Now the question is that whether Yousuf Raza Gilani, the chosen man of Zardari, will ask the Swiss Court to run case against President of Pakistan Asif Ali Zardari for the shady Swiss accounts.

Though there are 8500 beneficiaries of the NRO, only 35 are politicians and president of Pakistan tops that list. Justice should be begun from the top and that is why there is so much hubbub about president and his acolytes, and this NRO was specially designed for Mr. Zardari. The detailed decision of supreme court is not some person specific and instead it lays out a clear guideline for the future for combating the corruption.

Now Pakistan has a court of justice, which has declared a verdict which is a past towards glory. Days are changing. Hopes are coming back. Corruption is on the run.

  1. Pervez Musharraf
Congratulations to our Facebook community for crossing 100,000 members. With a firm belief that communication leads to an informed consensus, I look forward to our continued engagement. My sincerest best wishes to all of you.

  2. Short or long, verdict is verdict and government has already rejected it and showdown is imminent.

  3. My personal opinion is guys that lets just get over this. Let the judicial do its job and focus more on what we can do as individuals. What can one do to awaken the youth against militancy and emphasis on educational reforms so that we have a safe future.

  4. The detailed judgment of the court does not encourage a regime change in any way. One must remember in all fairness that a person is considered innocent until proven guilty. As the society has extended gracious support to judiciary the same courtesy should be given to the elected representatives

  5. All I know if this time once again the victims of Province of Sindh only then this Bona-fide matter will catch the color of PREJUDICE therefore it is utmost require to dispatch such giant size Criminals of the Punjab behind the bars also who are sitting as Corrupt Rtd. Army Generals or Bureaucrat or even as a Politicians.

  6. its very easy to pass anti government judgments. we all know that the govt is corrupt, but like you pointed out in your article there are 8500 beneficiaries, why does justice need to begin with a person, who is immune to any judgment for the present? are we not wasting time, and energy and maybe forwarding an agenda many are oblivious to?
zardari is corrupt and there are few who disagree, yet we focus ONLY on him, what about the General himself? What about the extended bureaucracy? what about the majority of the NRO beneficiaries?
personal grudges need to be set aside. Further destabilization of the current order is just going to create vacuum for religious parties, and the strongmen to move in again.
Already the government is not taking any decision without the consensus of the military, this sort of toppling over, will ony result in more of those decisions being taken by the force.
