Confiscation in the name of Treatment

By Dr RazaHaider • May 5th, 2009 • Category: Misc • 3 Comments

 Recently I came across a painful tragic article cum news wherein;

A terminally ill British teenager has won the right to die after she was taken to court by a hospital that wanted to force her to have a heart transplant.

Thirteen-year-old Hannah Jones has been in and out of hospital for most of the past 10 years, but now she has refused any more operations to prolong her life.

She has cardio myopathy; in layman’s terms, a disease of the heart muscle.

Hannah’s mother Kirsty Jones says it was caused by the high strength drugs she was given to treat a rare form of cancer. “She first got sick at the age of four with acute myeloid leukemia, and it was the chemotherapy that caused the heart failure, so we had to stop the chemotherapy,” she said.

But while she eventually beat the leukemia, her heart was left severely damaged, and can now only pump 10 per cent of its capacity.

Now she has refused a life-saving heart transplant and, in a show of maturity beyond her years, she told her doctors she would rather go home to die surrounded by her loving family.

“I’ve been in hospital too much and I’ve associated hospital with some bad memories; so that’s why I didn’t want the transplant.”

A child protection officer was called in and Hannah was on the brink of being forcibly removed from her home and her family.

The teenager was adamant that she did not want the transplant and she convinced the authorities that the operation was not in her best interests.

Now British officials have agreed to allow her to spend her remaining days at home.

Dr Daniel Sokol is a lecturer in medical ethics at St George’s Hospital in London; he also backs the 13-year-old’s decision.

“She’s a professional patient, she’s been a patient for most of her life and if she is able to understand, she comprehends and has enough information then it doesn’t matter whether she’s 13 or 88, it should ultimately be her decision in my view.”

Doctor’s warn that without the transplant Hannah could die within months.

Discussion:

This is such a painful and emotional, tragic tragedy.

Perhaps it’s a deliberate experimental negligence as crime; by same group of people as clinicians, who utilize skill and expertise in the name of profession; as only available left option of the victim therefore, the patient.

I don’t know where but should I must put this controversy in to irrationalism or in to the vocabularies concept of crime as offence.

This is a slap; a massive humiliating gesture by a 13 year old girl, who remained a victim of advancement and expertise in the name of treatment.

Nothing is truth but what has been floated and declared by the one who is at the verge of death.

This disrespect as discard by her, against the concept of advancement and this prestigious profession, has endorsed as rule that; her life was miserable due to so called treatment and every such step that was taken thereby to treat or to miser her more than her real disease.

Shame on this technology and unethical inflictions of irrational investigative procedures as experimentation! That has embarrassed this subject of medicine, through the hand of a girl, who still; and yet to be declared as mature thought.

This disregard as feel by this child is a moment of momentary crown of dishonor for medical professionals, which has pasted burned and blackened shadow to the concept of advancement and unethical subjection as skill therefore; explaining and highlighting this concept that these patient as ultimate sufferers, are a piece of cake for these experts to garnish their skill as experience over the soul of patient as victim.

Who can justify this act of clinician whom can not maintain their intimacy with a patient who has seen only suffering as birth?

How come this case been brought to the court by these offenders as clinician or hospital and has been astonishingly dismissed without confiscating and scrutinizing this issue as silent plea from a sufferer; who had virtually endorsed her feel that, she was been under trial of experiments in the name of treatment or in the name of ultimate relief.

This issue should have been treated by the court in the name of humanity and ailing victim considering her rejection of life and acceptance as death; a moment of thought.

In my opinion there is clear breach of ethics if she was deliberately drag and cordoned for treatment since it’s a real and clear violation of ethics in terms of consent.

No buddy can be put to treatment but with consent and approval of their legitimate or the concerned functionaries if at all there are no relations hence, being under the rule as governance; since it’s the prerogative and obligation as right and compulsion as well, of the government; to provide and console her citizen and is ethical too.

This is not at all a simple case of winning a right to die over a inflicted death but a controversy under ethical law that hold responsible all those who could not maintain their crown as expertise.

In my opinion this is a real time that government functionaries must hold responsible in order to console patient and her anxiety over the means of treatment and in addition must take immediate action through all available modes as concern; thereby to provide relief to the child through treatment.

This case and its data must be scrutinized in a real sense of ethics and moralities therefore inquire any breach and extra event as investigations or treatment so to ensure dying mind with console.

She must not die helplessly; disgracing this field of medicine hence all concerned as informed may be ethicist, government and readers; hence tagging all deaf and dumb.

We must prove our impression more loving and concerned towards her so to ensure her that this field of medicine would go for her, even in a miraculous deal with legitimate efforts thereby; to give her few more breathe as comfort and peace.

May God bless her with life and peaceful living in near to come days?

You are discussing such an issue that I am personally facing for last 4 years. Here My mother is bed ridden for last 4 years as she is diagnosed on 4th stage of Parkinson .We have changed many seniors doctors as no neuro physician could have been able to give her good combination of medicines that can improve her deteriorating conditions towards Parkinson only. Her all other body functions except her body movement are excellent but these are doctors hit and trial experiments that has brought her in same sentiments as that mentioned girl responded to her treatment. Now she hates her medicine and way to hospital that put her lot of more pain than her normal collapse. We as family first tried to force her to adopt all such treatment that is mandatory for Parkinson but after seeing the reaction and pain in her fragile body we have also given up this technology in the name of treatment and let her to live in her own way for her comfort and peace of mind.
We are now quite successful and You are right that loving and concerned attitude of love ones has helped these patients to live in more peaceful and calm ways of living than living with medicated torture. There is no second thought of it as I have personally experienced this phenomena.

thanks for your kind offer of professional help but really there is no such thing I have in my mind as you say continuous sorrow and pain regarding her ailment.I think I am very lucky daughter who has selected by God for taking care of her mother in this way.Her care to me is just like little gestures to return her nonreturnables passions and efforts for us.She is still our focus of love and respect by all means.I just want to share my personal experience with related topic and want to give message that sometimes our love ones are not in need of modern technologies for which we yearn from one place to another. Our compassionate behavior and closeness with them at this time of pain is become best remedy for their remaining life span. When I was with her in treatment process I felt the misbehavior of attendants and cold hearted attitude of their doctors.Attendants take them as burden and doctors treat them as experimental rats of Laboratory and reducing their life spans earlier than one who is kept in loving environment of close relations.I think this is main theme of your article.
As far as her treatment is concerned do you think that warrior person like me would have left any kind of deficiency in her matter who is most precious asset of my life.It is her pain and agony that has forced us to halt all kind of strong chemical treatment in form of high doses of medicines. She is being kept in minimum dose of sinemet and requip that creates no anxiety in her fragile body and three times a day physiotherapy are being done to activate her dying muscles.
Now as per my observation she is very mentally relaxed and comfortable and trying to coup with her illness with her own will power. We just do a little thing that we arrange all things around her as per her desire so that she lead an independent life with her full commands as she had before her sickness. This is showing much better result than our earlier experiment in the name of treatment.
