Capital punishment in Islam
By M. Waqas (Ex MPA) • Jul 27th, 2008 • Category: Misc • 11 Comments(2:179) In the Law of Equality (QISAS) there is (saving of) Life to you, o ye men of understanding; that ye may restrain yourselves.
(This is the most important verse of holy Quran regarding Qisas .Allah Almighty clearly guide the human kind to administer Qisas in your society and states that in this commandment there is life for the whole society. )
(According to this verse this is the fundamental right of the heirs of the slain to claim qisas or to forgive, no one else can use the right of abolishing the punishment.)
Narrated ‘Abdullah bin ‘Umar:
One of the evil deeds with bad consequence from which there is no escape for the one who is involved in it is to kill someone unlawfully.
(Bukhari Volume 9, Book 83, Number 3:)

nice
I suggest you send this to your political and your spritual leader Qazi Husain Ahmad and ask him to explain if killing by IJT is allowed for political differences (is it a just cause to force upon people your political views?).
17:33) Nor take life - which Allah has made sacred - except for just cause. And if anyone is slain wrongfully, we have given his heir authority (to demand QISAS or to forgive): but let him nor exceed bounds in the matter of taking life; for he is helped (by the Law).
very intersting
If someone is found guilty of killing, he or she should be brought to the justice and hanged .whether he or she belongs to IJT MQM or any one else.
Mr. aftab you under estimated me .first of all I am Muslim and staunch believer of Islamic injunctions and than member of jamat e islami. We have the courage to question our leadership but I don’t thing so that you have the same courage. You can only pass negative comments on very positive concepts.
M Waqas,
In principle what you say makes sense, the problem is that we do not have an “Islamic State” of where people actually apply sharia in their lives. It is delusional to believe that we actually have an Islamic State in Pakistan.
I do enjoy reading your articles, though if I may suggest, lets focus on how to better improve the living conditions of the common man and build better value systems as a whole. When Maulana Maududi, Allah ya rahma, started giving dawa to the masses in his khutbah’s, he started with very basic principles. These very basic principles we need to work on first before tackling the issue of establishing an “Islamic State” of where sharia can be applied.
Regards
“lets focus on how to better improve the living conditions of the common man and build better value systems as a whole.” This is it Doctor Sahib, you said it. Improvement of living condition entails all, the whole nine yards.
yes
its very important to improve the living standards of ordinary people and make a social reform revolution.but all of it will be done through understanding and practicing islamic sharia .Allah almighty promised in quran that if you follow my straight path i will give you rewards in this life and life hereafter.his cammandments are not only regarding namaz and rooza but He showed an enlighted path.in which human beings are bound to fulfill their duties regardind other humans and administer sharia law which is based on justice and equality of mankind.thus islamic system is best protector of mankind against social discreminations and injustices ,and provider of the basic human rights to all tha humanity.
Waqas Sahab, as far as I understand, Basic rights are the rights which all human beings have as human beings and these rights are absolutely, totally, and completely are independent of any religion or any political affiliations. These are rights must be protected / provided and be allowed to maintain their freedom from any attacks / usurpations / threats from other human beings as well as institutions, be that a state, a religion or various hierarchies.
In my view, no religion can or should be allowed to replace modern democracy. Islam has to come together with democracy and there can not and should not be any kind of theocratic state or state run by theocracy (mullahs / maulvis etc.) in which some self appointed or self nominated representatives of God abrogate all the powers of the state to themselves to rule, to legislate, to judge and consider themselves answerable to God alone and not the people. There must be well defined separation of power, government must be independent of all mullahs / maulvis / qazis etc. (of all colors and creeds); the freedom of faith and conscience and the rights to resist and legal opposition has to be guaranteed.
Basically it all boils down to - RIGHTS AND RESPONSIBILITIES of all the citizens in any Modern Democratic State.
ya
I do agree that Islamic state is not a theocratic state and no one is allowed to rule the masses according his own will. Unfortunately you are not aware about the salient features of an Islamic state. You are pre occupied with the concept of modern democracy. But if you look into the matter from unbiased corner you yourself will find that Islam gave more glorious principles for state and government. I would like you to read my book Islamic welfare state in Urdu which will soon be available for free download on TPS.
Yes, I do consider a democratic system of government the most desirable and also feasible and I do not regret my this political stand. However, this is prerogative a ‘mullah’ to talk about fortunes (taqdeer); I believe in a democratic system with equal opportunity for all what is ‘fortunate and what is ‘unfortunate’ becomes a function of individual’s efforts and preparedness.
Aftab Sahib,
Just trying to catch up with this exchange between you and Mr. Waqas.
May I ask you, what exactly is a “democratic system”? This discussion has gone deeper (maybe beyond my comprehension) and I am lost when references are made of “democracy” and a “democratic system with equal opportunity”.
I do not know if you have seen my remarks on other “hot topics” on TPS but I would love to read your words in depth. You would do us a great honor of sharing with us your words here on TPS. Maybe you can write some articles on your understanding of democracy or your own topic of choice. Please do consider
Thank you
